Phase II Model Ordinance |

Betsy Kane and Richard Whisnant, of the UNC School of Government and the Environmental Finance Center, under contract with the Division of Water Quality, developed the Phase II Model NC Stormwater Ordinance. This ordinance was developed to assist the 123 NC municipalities and 33 counties, who are subject to the National Pollutant Discharge Elimination System (NPDES) Phase II rules, meet these new statutory requirements. The Phase II rules, developed by the federal Environmental Protection Agency, and State of North Carolina Environmental Management Commission rules, were both promulgated to implement the Federal Water Pollution Control Act of 1972 (“Clean Water Act”). The Phase II Model Ordinance primarily focuses on the Post-construction aspect of the NPDES Phase II program. There is also a Section 7: Illicit Discharges, which may be adopted, if the local jurisdiction does not already have such an ordinance in place. |
