Express Review Overview
The Aquifer Protection Section’s Express Review Program allows an applicant to obtain a quicker review of permit applications on a set schedule. However, this does not guarantee issuance of the permit or provide any variance to design criteria, Division of Water Quality (Division) policies, or rules. The Division provides this service for time critical applications in exchange for higher application fees. The program is voluntary. The routine application process is still available under normal review times and procedures.
Express review is a highly structured process so it is imperative that the Division and the applicant follow the established process and timeframes. Projects should be straightforward and not include variances to rules, policies or procedures. It is also imperative that high quality applications be submitted. Additional information requests for plans, specifications, or calculations will require additional fees.

How To Apply
The Express Review website will be updated to show available Express Review tracks. These tracks will include the dates for the submittal, review and additional information (if applicable) meetings. The meeting dates in each track will be pre-selected by Express Review Staff, and are non-negotiable. Canceled meetings for unforeseen circumstances (i.e., sickness, emergencies, adverse weather, etc.) will be scheduled as quickly as possible without regard to the schedule.
Each Express Review track will be individually opened to the public approximately four (4) weeks prior to the submittal date. Acceptance requests may only be submitted via email (i.e., faxed and hand delivered requests will no longer be honored). The emailed request shall consist of the track number and FORM: APSERPR (http://h2o.enr.state.nc.us/lau/applications.html#EXPRESS).
Tracks will be considered open only when the Express Review web page states that the track is available for online requesting. Once an Express Review track is available, the Division will tentatively accept the first electronic request received after the track has been opened. Notification of an available Express Review track will be sent via electronic mail to those who have registered with the Express Review mailing list. The Division’s Central and appropriate Regional Express Personnel will review the request form for completeness within one (1) day of electronic submission. If deemed complete, the Division will notify the Applicant that they have two (2) business days to submit the original signed request form (FORM: APSERPR), an Express Review Acknowledgement Agreement (FORM: ERAA), and the appropriate fee. Failure to submit these required materials within two (2) business days will result in forfeiture of the Express Review track, and the next request in the waiting list will be reviewed.
If the signed request form, completed acknowledgement agreement and fee are received within two (2) business days, the track will be assigned to the Applicant (i.e., for a request received and tentatively approved on Tuesday, the Division must receive all required materials by the close of business on Thursday). The submitted fee will be processed and is NON-REFUNDABLE. The Division will utilize a waiting list until the available track has been filled. This waiting list will be based on the time of the request’s receipt. Failure to submit a complete electronic Express Review Request Form (FORM: APSERPR) will result in denial of your request, and the next request in line will be considered.
The Division may institute restrictions on some Express Review Tracks. For example an Express Review track may be only available to Minor Non-Discharge projects; Land Application of Residuals – Field Addition/Subtractions only; Coastal Projects; Piedmont Projects, etc. These restrictions are solely intended to increase the amount of Express Review projects accepted based on staff availability, and are not intended to exclude requests based on their merits.

Express Review Meetings
The Express Review Program requires several meetings that include the submittal, site visit, review and additional information (if necessary). Meetings dates are predetermined by the Division and posted online prior to the application process (except for the site visit date, which will be scheduled at the submittal meeting). This provides the Applicant with the ability to select the schedule that best fits their needs. In general, most meetings will be held in the Central Office; however, meetings in other locations may be held for convenience at the discretion of the Division. Table 1 shows the general structure of an express review project.

Submittal Meeting – The submittal meeting provides an opportunity to discuss the project in general, give a history of the site, discuss design considerations, ask any initial questions of the reviewers, and ensure the application is complete. Failure to submit critical materials such as Plans, Specifications, Soils Report, Hydrogeolocial Report (if necessary), Calculations and the appropriate Application shall result in immediate return of the project and forfeiture of paid fees. For this meeting process to be successful, the owner and all consultants must be present. The Division will ensure all reviewers are present as well.
Site Visit – The site visit will be scheduled prior to or during the submittal meeting. Attendance at the site visit is not mandatory for the Applicant, however it is encouraged. Depending upon the nature of the project, attendance may be required for some or all of the consultants. Attendance requirements for consultants will be discussed at the time that the site visit is scheduled. The site visit shall be conducted within 10 days of submittal of the application.
Review Meeting – The review meeting is always scheduled two weeks after submittal. The applicant (meeting the definition in 15A NCAC 02T .0106), licensed professional (engineer, soil scientist, geologist), and other consultants must be present. It will be assumed that all consultants must be present unless the Division notifies the applicant the consultant is not needed. At the review meeting, the Division will present a written request for additional information, and will orally review this request with the Applicant. This process allows an open discussion of the project, and simple changes can be made to the package to alleviate concerns and correct deficiencies. Deficiencies that cannot be addressed in the review meeting must be submitted to the Division within fourteen (14) calendar days of the review meeting. The application will be returned as incomplete by certified mail/return receipt requested (Division will retain the express fee) for failure to submit the additional information fee within the stipulated timeframe. Any requested information not submitted within the fourteen (14) calendar days
to all designated office locations
will automatically result in another additional information request letter with associated fee. Requests for extensions will not be considered.
Additional Information Meeting(s) – Within seven (7) days of submittal of all requested additional information and the associated fee, the Division will notify the Applicant if an additional information meeting is necessary. It will be assumed that all consultants must be present unless the Division notifies the applicant the consultant is not needed. This meeting follows the same format as the Review Meeting, and provides the Applicant fourteen (14) calendar days to provide the requested information and the additional information fee. Additional information meetings will continue until all of the Division’s concerns are addressed.

Express Review Fees
In exchange for the additional level of review effort and the set review schedule, the applicant agrees to the Express Review Program fee. Table 2 provides the fee schedule for Express Review Program applications. The annual fee reverts back to the normal fee schedule. In addition to the application fee, an additional information fee is also required for each additional information review required after the review meeting. Express Review Program additional information fees are also provided in Table 2.

Permit Drafting & Issuance
Permits will generally be drafted within one to three (1-3) business days after the final review meeting. The Applicant will receive an electronic draft permit, and will have three (3) business days to provide their comments. Once the draft comment period has concluded, the permit will be immediately submitted for signature.
Please note that permits may be considered incomplete until other information is submitted related to public comments, other approvals which may impact the design of the permitted facilities (e.g. – a 401 certification for impacted wetlands), review by the applicant of draft permits, etc. If the Director deems a public meeting necessary, the express review process can be followed until the public process is engaged. Once the public process begins (after preparation of a draft permit), the Division cannot establish a set review time. In addition, the Director must sign any permit that requires a public meeting.
