Update Of Fees For Permit Activities
The final budget approved on July 31, 2007 includes an increase to most fees associated with Division of Water Quality permit activities, including Animal Operations. This increase represents the first change in fees since 1999 and reflects inflationary costs associated with program delivery. Beginning September 1, 2007, all permit fees collected must meet the legal requirements of these fee changes. The budget bill that was passed can be viewed here; scroll down to pages 262-265.
.0200 Rules Update
The revised .0200 Rules have been approved and went into effect on September 1, 2006. The rules were codified into a new chapter NCAC 15A 02T: Waste Not Discharged to Surface Waters. The Animal Waste Management Systems rules are now combined into Section .1300, and the new Manure Hauler Operations rules are in Section .1400.
EPA's CAFO Rule and Lawsuit Status
EPA has proposed revisions to the CAFO Rule based upon the ruling by the 2nd-Circuit Court of Appeals in the Waterkeeper et al. v. EPA. The rules are avaialble for review by selecting the following link: Concentrated Animal Feeding Operations Proposed Rulemaking, June 2006. The new rules are scheduled to take effect on July 31, 2007.
In particular, the proposed rules address the "duty to apply" ruling by the Court by changing the requirement to those facilities that "discharge or propose to discharge" and the public notice responsibilities of the permitting authority to provide opportunity for public comment on each NPDES-permitted facility's nutrient management plan.
